In order to protect the interests and rights of FishFlashGames.com, and FishFlashGames.com users alike, these Terms of Use has been developed. Users or visitors found violating these terms here within will be held responsible and proper recourse may be taken, including account termination, criminal prosecution (when and where applicable), and so forth.

1. MEMBERSHIP REQUIRMENTS
1. MEMBERSHIP ELIGIBILITY: To participate in FishFlashGames.com, you must be an individual at least 13 years of age. A user under 18 certifies that a parent has given permission by checking the box that corresponds to "I Agree." during enrollment.
2. Users must provide valid and truthful information during all stages of membership at FishFlashGames. This clause applies to every form of interaction with a FishFlashGames.com representative, FishFlashGames web properties, and FishFlashGames.com affiliated advertisers and partners, including, but not limited to: personal information, location, support tickets, manual requests, third-party signup information.
3. Users must reside in the United States of America.
4. Users must not create more than one account per person.
2. ACCOUNTS
   
   FishFlashGames.com users are given the right to cancel their account at any time, no matter the reason. However, upon cancelation the user automatically forfeits their rewards, points, and all other data attached to their account.
   1. Termination
      FishFlashGames.com reserves the right to terminate a user's account at any time for any reason deemed publically or privately necessary. Upon termination, the user in question may lose the rights to their rewards, points, and all other data attached to their account. Termination may occur when these terms herein are broken; the user is found trying to damage the website here or on the Internet in general. Furthermore, FishFlashGames.com reserves the right to not have to publically discuss the reasoning behind a account termination.
   2. Information
      FishFlashGames.com requires certain pieces of personal information from it's users in order to contact them, distribute gifts, or complete other operations necessary for the website. In the same respect, users are expected to and must supply sufficient truthful information. Any user found purposely (as per FishFlashGames.com discretion) supplying false information may be subject to account termination.
   3. Accounts Allowed
      FishFlashGames.com allows up to one account per person, no matter how many email addresses he or she may maintain. Furthermore, a household may have more than one account for each member of that household over the age of thirteen (13). Related members may not specify one another as referrals either. FishFlashGames.com reserves the right to monitor, track, or otherwise analyze accounts to catch infringing users.
   4. Personal Information
      FishFlashGames.com requires and collects certain personal information from its users including but not limited to their first name, last name, email address, date of birth, gender, postal address, city of residency, state of residency, and zip code of residency. These portions of personal information are required for several purposes including but not limited to, making FishFlashGames.com more personal, distributing gifts to its members, contacting its members via postal mail and email for the purposes of promoting the website or keeping the users informed.
3. PHYSICAL RESIDENCY
   Because of the nature of FishFlashGames.com, users participating in the website must be residents of the United States. This is for many reasons, but mainly because we cannot facilitate the distribution of gifts to users outside of the United States.
4. UNAUTHORIZED ACCESS
   FishFlashGames.com monitors all access by visitors and users to the website. Unauthorized access is strictly prohibited and will be tracked by such monitoring. Any person (including visitors and members) found accessing a portion of the website that they are not authorized to access will be punished to the full extent possible, including criminally if possible.

6. IMITATION OF LIABILITY. TO THE MAXIMUM EXTENT ALLOWED BY APPLICABLE LAW, NEITHER FISHFLASHGAMES.COM NOR ANY OF ITS MEMBERS, SUBSIDIARIES, PUBLISHERS, SERVICE PROVIDERS, LICENSORS, OFFICERS, DIRECTORS OR EMPLOYEES SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATING TO THIS AGREEMENT, RESULTING FROM THE USE OR THE INABILITY TO USE THE SERVICE OR FOR THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES OR RESULTING FROM ANY GOODS OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH THE SERVICE OR RESULTING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF USER'S TRANSMISSIONS OR DATA, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, USE, DATA OR OTHER INTANGIBLE, EVEN IF SUCH PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL FISHFLASHGAMES.COM TOTAL CUMULATIVE LIABILITY TO ANY MEMBER UNDER THIS AGREEMENT EXCEED AN AMOUNT EQUAL TO THE VALUE OF ONE HUNDRED (100) REWARD POINTS FROM FISHFLASHGAMES.COM.
